These Terms of Service (“Terms”) govern your access to and use of the website, products, and services offered by SilvaDes LLC (“SilvaDes,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Illinois, located in Washington, Illinois (Tazewell County).

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the site or purchase any products.

1. Eligibility

You must be at least 18 years of age to use this website or place an order. By using the site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

2. Products and Services

SilvaDes designs and manufactures custom and production automotive parts using industrial-grade additive manufacturing (3D printing). We also sell digital manufacturing files (STL, 3MF). All product descriptions, specifications, and images on the site are provided for informational purposes and are as accurate as reasonably possible, but we do not warrant that descriptions are error-free or complete.

3. Orders and Payment

All orders placed through silvades.com are subject to acceptance by SilvaDes. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

Prices are listed in U.S. dollars and are subject to change without notice. Payment is collected at the time of purchase through our third-party payment processor. SilvaDes does not store your credit card or payment account information.

4. Shipping and Delivery

In-stock physical products ship from Washington, IL within 1–3 business days. Estimated delivery times are provided as a courtesy and are not guaranteed. SilvaDes is not responsible for delays caused by shipping carriers, weather, customs, or other factors beyond our control.

Risk of loss and title for physical products pass to you upon delivery to the carrier.

5. Returns, Replacements, and Refunds

Our return and replacement policy is detailed on our Return & Replacement Policy page. By placing an order, you acknowledge and agree to the terms of that policy, including:

• Physical products are eligible for a one-time free replacement if they arrive damaged or defective, subject to our verification process
• All digital product sales are final — no refunds or credits for digital downloads
• Orders may only be cancelled before entering the shipping/fulfillment process

6. Digital Products — License Terms

Digital files purchased from SilvaDes (including STL, 3MF, and other manufacturing files) are licensed, not sold. By purchasing a digital product, you are granted a limited, non-exclusive, non-transferable, single-user license for personal manufacturing use only.

You may not:

• Redistribute, resell, sublicense, or share the files with any third party
• Use the files for commercial production or resale of printed parts without prior written authorization from SilvaDes LLC
• Reverse-engineer, modify, or create derivative works of the files for distribution
• Claim ownership or authorship of the designs

Violation of these license terms may result in legal action and immediate revocation of the license.

7. Intellectual Property

All content on silvades.com — including but not limited to text, graphics, logos, images, product designs, CAD models, photography, video, and software — is the property of SilvaDes LLC and is protected by U.S. and international copyright, trademark, and intellectual property laws.

The SILVADES name, logo, and associated branding are trademarks of SilvaDes LLC. You may not use, reproduce, or distribute any content from this site without our prior written consent.

To the maximum extent permitted by applicable law, SilvaDes LLC, its owner, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the website or any products purchased from SilvaDes.

In no event shall our total liability to you for all claims arising from or related to the use of our website or products exceed the amount you paid for the specific product giving rise to the claim.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if SilvaDes has been advised of the possibility of such damages.

All products are provided “as is” and “as available.” SilvaDes LLC expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

SilvaDes does not warrant that any product will meet your specific requirements, that products will be free of defects, or that the website will be uninterrupted or error-free.

11. Assumption of Risk

You acknowledge and agree that the installation and use of aftermarket automotive parts involves inherent risks. By purchasing and installing any product from SilvaDes, you assume all risk of personal injury, property damage, and vehicle damage arising from the use of our products. SilvaDes LLC is not responsible for damage resulting from improper installation, modification of our products, use on incompatible vehicles, or failure to follow provided instructions.

12. Indemnification

You agree to indemnify, defend, and hold harmless SilvaDes LLC, its owner, members, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the website, any purchase you make, your installation or use of our products, or your violation of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Tazewell County, Illinois, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Before initiating any formal legal action, you agree to first contact SilvaDes in writing at the email address below and allow thirty (30) days to attempt to resolve the dispute informally.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
